Included is a request for deferral of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
The subject site includes approximately 3,460 acres on the south side of SW Kanner Highway and approximately 442 acres on the north side of Kanner Highway which is also adjacent to the C-44 Canal.
The site currently has a future land use designation of Agricultural and is zoned A-2, Agricultural District. The property has historically been used for cattle grazing and tree farms.
The property has a concurrent Comprehensive Growth Management Plan (CGMP) amendment for a future land use map (FLUM) change and text amendment regarding applying the Rural Lifestyle land use to the subject property. This application is contingent on the approval of those amendments. The transmittal public hearings on the FLUM amendment and CGMP text amendment were heard before the BCC on December 5th, 2023. The Board voted to transmit the amendments to the appropriate state agencies for review and comment.
The request is to rezone the property from A-2, Agricultural District to PUD pursuant to The Ranch PUD Zoning Agreement. The PUD will allow clustering of 175 residential units, the extension of water and wastewater service to the property, two 18-hole golf courses and related amenities, and a residential docking facility. The project as proposed will be constructed in three phases. The current application is for master plan approval and final site plans are required to facilitate construction.
This matter was properly noticed and heard before the Local Planning Agency (LPA) on April 18, 2024. The LPA’s recommendation will be forwarded to the Board.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the Resolution approving the rezoning from A-2, Agricultural District to Planned Unit Development and approve The Ranch PUD Zoning Agreement including the Master Site Plan and Phasing Plan.
