EXECUTIVE SUMMARY:

This is a request by Lucido & Associates on behalf of Atlantic Fields Club, LLC for final site plan approval for Phase 1C, Tract M2, maintenance facility and associated infrastructure. The subject site is an approximate 21.3-acre portion of the 1,530-acre Discovery Planned Unit Development (PUD). The property is located north of Bridge Road approximately one mile east of the I-95 Interchange at 2935 SE Bridge Road in Hobe Sound. Included is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Discovery PUD, including the Master and Phasing Plan, was approved September 13, 2022. The Discovery PUD is a platted residential development consisting of a maximum of 317 residential units, recreational facilities that include a golf course and other amenities on approximately 1,530.9 acres in Hobe Sound.

 

This proposed Phase 1C final site plan includes existing and proposed agricultural and golf maintenance facilities, administrative offices and related infrastructure located on Tract M2 created by way of the recorded plat. The Phase 1C final site plan is consistent with the approved Master and Phasing plans recorded by way of the Third Amendment to the PUD Zoning Agreement.

 

Review of this application by the Local Planning Agency is not required.

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION

1.                     Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move that the Board adopt the Resolution approving the Phase 1C Final Site Plan Tract M2 for the Discovery PUD project.
