This is a request for final approval of a Residential Contract for Sale and Purchase (Contract), the adoption of a resolution approving and accepting a Special Warranty Deed for the acquisition of property on the south side of SE Salerno Road, and the adoption of a resolution to initiate a Future Land Use Map amendment to the Comprehensive Growth Management Plan.

Purchase price $604,375.00, plus due diligence and closing costs not to exceed $6,000.

Staff identified the need to acquire the property located at 4070 SE Salerno Road, in Port Salerno as additional greenspace for the community. The property abuts Salerno Creek, which leads to the Salerno Creek Retrofit STA and consists of just under 1 acre, containing a 914 sq ft structure, along with a detached garage and storage area.

Staff entered into a conditional contract in the amount of $604,375, with Christina Waldron Fortin, a single woman, for the purchase of the property. Staff has obtained two (2) appraisals pursuant to Section 125.355(1)(b), Florida Statutes. The average of the two appraisals is $622,500. Closing is scheduled to occur on or before December 22, 2025.

Funding for this project will come from District 4 MSTU.

All closing documents will be approved by Legal prior to closing.

Staff is recommending that, subsequent to the closing on the property, the Board initiate a Future Land Use Map amendment to change from CRA Center to General Institutional in alignment with most other County owned properties.

Sec. 139.31 and 139.32, General Ordinances, Martin County Code require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by resolution by the Board of County Commissioners

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, and legal staff have identified and addressed legal risks and developed strategies for legal defensibility, as applicable.

RECOMMENDED ACTION:

RECOMMENDATION
Move that the Board:
a. authorize the final approval and execution of the Residential Contract for Sale and Purchase;
b. adopt a resolution approving and accepting the Warranty Deed for the acquisition of the property located at 4070 SE Salerno Road from Christina Waldron Fortin;
c. adopt a resolution initiating a future land use map amendment to the comprehensive growth management plan;
d. authorize the use of District 4 funds for the purchase and closing costs associated with this parcel; and
e. authorize the Chair to execute any and all documents necessary to complete this transaction.
