This is a request by HJA Design Studio, on behalf of Croc Enterprises, LLC., for a proposed amendment to the Martin County zoning atlas to change the zoning district classification on one lot with an approximate area of 0.69 acres from M-2, Industrial District, to LI, Limited Industrial District. The LI zoning district is consistent with the site’s current future land use designation of Industrial. Included with this application is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:
The subject site is Lot 4, Block 2, of the S.P.S. Commercial Center subdivision plat, as recorded in Plat Book 5, Page 33 of the Public Records of Martin County, Florida. It is located at 2988 SE Monroe Street, approximately 0.13 miles southwest of SE Commerce Avenue in Stuart.
The site is currently zoned M-2, Industrial District, a Category "C" Zoning District consistent with the Industrial Future Land Use. A zoning change has been requested to remove the old zoning district and to assign a standard zoning district consistent with the Industrial land use. A zoning change is necessary to update the property’s development standards.
There are three (3) standard Category “A” zoning districts available to implement the Industrial land use policies of the Comprehensive Growth Management Plan (CGMP): LI (Limited Industrial District), GI (General Industrial District), and HI (Heavy Industrial District). The property’s width being 100 feet excludes GI and HI Districts, which both require minimum 125-foot lot widths. The applicant is proposing to rezone the property to the LI, Limited Industrial District, which permits the least intensive industrial use and is the appropriate zoning district for the property.
This item is scheduled to be heard by the Local Planning Agency on September 3, 2026. The recommendation will be provided to the Board of County Commissioners.

Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process to cross-examine witnesses, present evidence, demand that witnesses testify under oath and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and all its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt a resolution approving the request to rezone from M-2, Industrial District to LI, Limited Industrial District, for subject property owned by Croc Enterprises, LLC.
