Pursuant to Chapter 9 Animals, General Ordinances, Martin County Code, the Board may adopt a Resolution to establish the penalties, fines, rules, and regulations for animal control violations, and for licensing and vaccinations. This amended Resolution updates the fines and penalties imposed for violations of the designated County ordinances, which are civil infractions.

BACKGROUND/RELATED STRATEGIC GOAL:
On November 7, 2024, the Animal Care and Control Oversight Board, at the request of staff, made recommendations as to the amounts of fines imposed for violations of Chapter 9. These fines are collected by the Clerk of the Court and are deposited into the County Government accounts and support, in part, training of the animal control officers. The Board has the power to establish such fines and penalties, pursuant to Chapter 9. Since the last resolution went into effect in 2015, several amendments have been made to Chapter 9, Article 4, Animal Control, Care and Treatment. This Resolution addresses new sections and provides updated recommended amounts. Staff has recommended the reduced fees amount for those who do not contest the citation, as is required by statute.
The amounts set forth as to licensing shall remain intact, but for the removal of the lifetime registration, at staff’s request, to conform with Chapter 9. Staff intends to present to the Board any changes to licensing, if needed, after the close of fiscal year 2024-2025 and upon input from the Tax Collector’s Office as to operational costs.

RECOMMENDATION
Move that the Board adopt the Resolution relating to the civil penalties, fines, rules and regulations for animal control violations, licensing, and vaccinations and rescind all prior Resolutions relating thereto.
