This request is for the adoption of a resolution replacing Resolution No. 24-6.15, adopted on June 18, 2024, which directed staff to sell two County-owned parcels through the Request for Proposal (RFP) process. The new proposed resolution instead authorizes staff to market and sell the properties through the County-approved auction process. Public auctions have proven to be a more effective method of selling County-owned property while also allowing for greater public participation and a more competitive sales process.

BACKGROUND/RELATED STRATEGIC GOAL:
On June 18, 2024, the Board adopted Resolution No. 24-6.15, authorizing staff to present two County-owned parcels to the Golden Gate Neighborhood Advisory Committee and the Community Redevelopment Agency (CRA) for review and concurrence of an RFP for the disposition of the following two parcels:
• Parcel #1: 5703 SE 47th Avenue, New Monrovia (PCN: 25-38-41-001-000-00330-1); and
• Parcel #2: 10 platted lots with an unassigned address located between SE Hawthorne St. and SE Iris St. Golden Gate (PCN: 37-38-41-007-146-00010-8)
Both parcels have since been presented to the respective committees and agencies and received the necessary concurrence.
Consistent with the Board’s prior direction, the initial intent was to solicit proposals through the RFP process from nonprofit housing organizations, community land trusts, and qualified developers for the conveyance of the properties for affordable housing purposes, subject to appropriate deed restrictions and reverter provisions.
During preparation of the RFP’s, staff evaluated the proposed disposition process and considered alternative methods that could better achieve the Board’s affordable housing objectives. Based on that evaluation, staff determined that marketing these properties through the County’s contracted public auctioneer would provide a more competitive, transparent, and publicly accessible process while continuing to support the County’s affordable housing goals.
The Golden Gate properties could be marketed to licensed contractors, nonprofit housing organizations, community land trusts, or other qualified entities or individuals committed to developing affordable housing. The New Monrovia parcel is a residential parcel acquired through the State Housing Initiatives Partnership (SHIP) Program. Accordingly, any proceeds from its sale must be returned to the SHIP Program in accordance with program requirements, thereby supporting future affordable housing initiatives.
Staff is requesting that the Board adopt the proposed resolution rescinding Resolution No. 24-6.15 and authorizing the sale of the two (2) parcels through the County’s contracted auctioneer process in lieu of the previously authorized RFP process. The proposed resolution also updates the County's Affordable Housing Inventory List in accordance with Section 125.379(1), Florida Statutes.
ISSUES:
Upon successfully auctions, staff will return to the Board for acceptance and approval of any proposed sales to support affordable housing.
LEGAL SUFFICIENCY REVIEW:
This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, and staff have identified and addressed legal risks and developed strategies for legal defensibility, as applicable.
RECOMMENDED ACTION:
RECOMMENDATION
Move that the Board:
1. Rescind Resolution 24-6.15;
2. Adopt the proposed Resolution (i) updating the inventory of County-owned property appropriate for use as affordable housing in accordance with Section 125.379, Florida Statutes, and (ii) authorizing staff to market and sell the above referenced parcels through the County’s contracted auction process for development as affordable housing by licensed contractors, nonprofit housing organizations, community land trusts, qualified entities, or individuals committed to developing affordable housing; and
3. Authorize the Chair to execute any documents necessary to complete this transaction.
