This is a request for approval of the First Amendment to the Seven J's North Industrial Park Planned Unit Development (PUD) Zoning Agreement. The proposed amendment is to increase the existing lake depth from 20 feet to 40 feet. The subject site is located north of the approved Seven-J's Industrial Subdivision and east of the Martin County Recycling Landfill, at the north terminus of SE Poma Drive, approximately 0.5 miles north of SW Busch Street, 1.5 miles north of SW Martin Highway, in Palm City. Included with this application is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Seven J’s North Industrial Park PUD Zoning Agreement including a master/final site plan and Preserve Area Management Plan (PAMP) was approved September 27, 2022. The site has an Industrial Future Land Use and consists of 37 permit ready parcels on approximately 60.37-acres of the 167.14-acre site.

 

A plat application is currently in review for the purpose of subdividing the area and will be heard before the Board at a future date.

 

This First Amendment to the Seven J’s North Industrial Park PUD Zoning Agreement is being requested to revise Exhibit D, Master/Final Site Plan, and Exhibit F, Special Conditions, of the PUD Zoning Agreement, to increase the existing lake depth from 20 feet to 40 feet.

 

Review of this application is not required by the Local Planning Agency (LPA).

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move the Board approve the First Amendment to the Seven J’s North Industrial Park Zoning Agreement including the Revised Master and Final Site Plan.

Direct staff accordingly.
