Juliet Bravo Holdings, LLC filed an informal 14 CFR Part 13 Complaint with the Federal Aviation Administration (FAA) relating to the award of a lease to Daher Aerospace at Martin County Airport/Witham Field after a competitive Request for Proposals (RFP). Staff is proposing a voluntary Corrective Action Plan to submit to the FAA for Board approval.

BACKGROUND/RELATED STRATEGIC GOAL:
On October 22, 2023, the Airport issued a formal solicitation for Lease of Property at the Martin County Airport/Witham Field for Aeronautical Purposes (RFP-2024-3522). The Airport received responses from
Daher Aerospace, Juliet Bravo Holdings, LLC and Sky Harbor Group. On November 28, 2023, the Selection Committee recommended that Daher Aerospace, Inc. be awarded the bid.
On November 9, 2023, the Airport was notified by the FAA, Southern Regional Office - Airports Division, that a 14 CFR Part 13 Complaint was filed by Juliet Bravo Holdings, LLC. A Part 13 Complaint is an informal complaint process that is a public method of reporting possible compliance violations against an Airport where the FAA evaluates the facts surrounding the Complaint, identifies possible sponsor violations, if any, and offers assistance to resolve the Complaint in a manner consistent with the Airport’s Federal obligations. In response to the Part 13 Complaint, Board direction and approval is needed for submittal of a voluntary Corrective Action Plan to the FAA.
A separate Part 16 complaint is pending relating to the same issues. A Part 16 Complaint is a formal administrative proceeding with the FAA. The Airport is cooperating with the FAA to resolve both the Part 13 and Part 16 Complaints.
ISSUES:
The voluntary Corrective Action Plan must be submitted to the FAA by January 2, 2026.

Move that the Board provide staff with direction and approve submittal of the voluntary Corrective Action Plan to the FAA.
