The 1.54-acre site currently contains a vacant restaurant building located at 4110 NW Federal Highway, at the southwest corner of NW Eugenia Street and NW Federal Highway, in Jensen Beach. The site is located on Parcel 12.7 of Phase 1B of the West Jensen PUD. Included is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:
The site has a future land use of General Commercial and is zoned PUD-WJ, West Jensen Planned Unit Development. The site consists of Parcel 12.7 within Phase 1B of the West Jensen Planned Unit Development/Development of Regional Impact (PUD/DRI), which was originally approved in 1989 and has been subsequently revised.
The subject site has been occupied by an approximately 5,300 square-foot restaurant since 2003 which is now vacant. The current application proposes to demolish the existing structure and to construct an approximately 2,417 square-foot bank building with drive-through teller lanes and associated infrastructure.
The proposed project is consistent with the most recent revised master plan, which was approved on November 22, 2022, as part of the 14th Amendment to the PUD zoning agreement. The non-residential portion of Phase 1B consists of approximately 130 acres located along the NW Federal Highway and Goldenrod Road corridor. This development has established concurrency pursuant to the approved DRI and does not result in any increases in square footage, area, or intensity of development as previously approved and vested and therefore qualifies for a Certificate of Public Facilities Exemption. The project is located inside the Primary Urban Services District with water and wastewater services available from Martin County Utilities.
Access will be provided via an existing drive aisle connecting to NW Eugenia Street. No direct access will be provided from NW Federal Highway.
The applicant is subject to a restoration planting plan for the landscape buffer along NW Federal Highway. This landscape buffer is a requirement within the West Jensen PUD. The applicant removed native plant material within a portion of the landscape buffer without approval from the County. The restoration plan requires planting of saw palmetto, oak trees, and pine trees to replace the removed vegetation and ensure long term survivability.
The applicant is proposing alternative compliance from certain provisions within Martin County Land Development Regulations, Article 4, Division 20, Commercial, Multifamily, and Industrial design. The requested alternative compliance consists of relief from building massing requirements on the northeast façade and roofline variation requirements on the southeast façade to accommodate HVAC equipment screening.
Pursuant to Article 10, Table 10.5.F.9, Martin County Land Development Regulations, review of this application is not required by the Local Planning Agency (LPA).

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi- judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross- examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the Resolution approving the revised final site plan for West Jensen PUD, Phase 1B, Parcel 12.7.
