BACKGROUND/RELATED STRATEGIC GOAL:
1. Agreement Drafted by:
Florida Department of Transportation (hereinafter FDOT) and Martin County staff.
2. Parties to the Agreement:
FDOT and the Martin County Board of County Commissioners.
3. Purpose of the Agreement:
To assign responsibility for maintaining the drainage facilities that support a new Multi-Use Trail along State Road (hereinafter SR) SR-5 (US-1/SE Federal Highway) in Hobe Sound.
4. New/Renewal/Modified:

5. Duration of the Agreement:
In perpetuity or if the Multi-Use Trail exists.
6. Benefits to Martin County:
The Multi-Use Trail will provide a safe alternative to bicycle lanes along SR-5 (US-1/SE Federal Highway) in Hobe Sound and will provide another segment of the Shared-Use Nonmotorized (hereinafter SUN) Trail network along the East Coast Greenway.
7. Cost to Martin County:
Anticipated maintenance costs associated with drainage are less than $1,000 per year.
At the request of the Martin Metropolitan Planning Organization, the FDOT is proposing to construct a Multi-Use Trail within its right-of-way for SR-5 (US-1/SE Federal Highway) from the Hobe Sound National Wildlife Refuge to SE Osprey Street in Hobe Sound with Project Numbers 443505-1-52-01 and 448447-2-52-01. The proposed Multi-Use Trail will become part of the SUN Trail network, which is part of the East Coast Greenway from Florida to Maine.
The FDOT and County staff are drafting a Maintenance Memorandum of Agreement for the improvements associated with the proposed Multi-Use Trail, which assigns the responsibility to maintain the drainage facilities, signs, signposts, and pavement markings associated with the Multi-Use Trail within the FDOT’s right-of-way to the County. The Maintenance of Memorandum Agreement also assigns the responsibility for keeping the Multi-Use Trail free of graffiti, residue, obstructions, and vegetation to the County. The Board is asked to authorize the County Administrator to execute a Maintenance Memorandum of Agreement.

RECOMMENDATION
Move that the Board adopt the Resolution authorizing the County Administrator, or designee, to execute the Memorandum of Agreement for the proposed Multi-Use Trail along SR 5 (US-1/SE Federal Highway) in Hobe Sound and future amendments and modifications to the Agreement, as necessary.
