BACKGROUND/RELATED STRATEGIC GOAL:

 

1.                     Agreement drafted by: Martin County

2.                     Parties to the Agreement: Martin County and SPPOA

3.                     Purpose of the Agreement: To establish a long-term protocol and cost-share framework for joint beach and dune reconstruction and ongoing storm protection projects for Bathtub Beach Park and adjacent Sailfish Point beachfront property.

4.                     New/Renewal/Modified: New Agreement.

5.                     Duration: Five (5) year review period, with annual coordination meetings and opt-out provisions if funding is unavailable at the time of construction.

6.                     Benefits to Martin County: This agreement formalizes collaboration and establishes a defined cost-share structure for shoreline protection along a contiguous stretch of beach. A joint project approach ensures proportional benefits, coordinated construction, reduced mobilization costs, improved access logistics, and extended project longevity. Combining efforts minimizes impacts, reduces overall unit costs, and enhances the effectiveness of storm protection measures.

7.                     Cost: Project-specific; SPPOA will provide a 31.51% cost share of eligible project expenses, including engineering, permitting, construction, and required monitoring. County funding for Bathtub Beach maintenance is programmed through the Capital Improvement Plan, with anticipated SPPOA contributions reflected accordingly.

 

On May 21, 2019, the Board approved a Memorandum of Understanding (MOU) with SPPOA to facilitate jointly funded storm protection projects extending from the north end of Bathtub Beach Park south to an area near the Sailfish Point Clubhouse. The agreement established a long-term framework for cooperative shoreline management and cost sharing for beach nourishment and related storm protection activities.

 

The collaborative projects completed under the MOU have demonstrated that a joint approach remains the most efficient and effective method to address erosion along this contiguous shoreline. Because work performed on one property directly affects adjacent properties, partnership between the County and SPPOA continues to be in the mutual interest of both parties.

 

Staff from Martin County and SPPOA continue to evaluate shoreline conditions and potential long-term strategies; however, both parties support reissuing the MOU to allow storm protection efforts to continue as needed. Extending projects into Sailfish Point enhances overall project performance and prolongs the expected life of the shoreline improvements.

 

Under the updated MOU, Martin County will remain responsible for contracting and administering construction activities. SPPOA will continue to provide a 31.51% cost share of eligible project expenses, including engineering, permitting, construction, and required monitoring. The parties will meet annually to review shoreline conditions and coordinate construction planning. The agreement will remain subject to periodic review and includes opt-out provisions should funding not be available at the time of project bidding.

 

Funding for Bathtub Beach maintenance is included in the County’s Capital Improvement Plan, with anticipated SPPOA contributions reflected accordingly.

RECOMMENDATION

Move that the Board authorize the Chair to execute the Memorandum of Agreement between Martin County and the Sailfish Point Property Owners and Country Club Association.

Pull this item from the Consent Agenda and provide direction to staff.

RECOMMENDATION

It is anticipated that state grants will be used to supplement the projects constructed under this MOA.  The County’s share and funding options will be determined during the design process of each individual project.
