BACKGROUND/RELATED STRATEGIC GOAL:

As a condition of approval of the Phase 1 Final Site Plan PUD for The Ranch, JWA has provided a Warranty Deed for 100,746 square feet of right-of-way along SE Bridge Road in Stuart.

The Applicant has provided the required due diligence materials, along with an executed Affidavit of No Conflict.  The Real Property Division has confirmed ownership of the property to be conveyed, and there are no mortgages encumbering the premises.

Sec. 139.31 and 139.32, General Ordinances, Martin County Code, require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by resolution of the Board of County Commissioners of Martin County.

Sec. 336.08, Fla. Stat. states the Board may designate the property as a public County Road by adoption of a Resolution.

RECOMMENDATION

Move that the Board:

a.                     adopt a Resolution approving and accepting a Warranty Deed from JWA Ranch, LLC, a Delaware limited liability company, dedicating 100,746 square feet of right-of-way along SE Bridge Road; and

b.                     authorize the Chair to execute all documents necessary to complete this transaction.
