This is a request for approval of a Third Amendment to the Discovery PUD Zoning Agreement including a revised master and phasing plan for the purpose of adjusting the Golf Clubhouse and Kid’s Club Adventure Park Recreation Tracts and adding a lake clubhouse within the lake adjacent to the Clubhouse Tract. The Discovery PUD is an approximately 1,530-acre property located north of Bridge Road approximately one mile east of the I-95 Interchange at 2935 SE Bridge Road in Hobe Sound. Included is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Discovery PUD Zoning Agreement was approved on September 13, 2022 and includes a maximum of 317 residential units on approximately 1,530 acres resulting in a gross residential density of approximately 1 unit per 5 acres. The project also includes an 18-hole golf course and resort style club amenities.

 

The First Amendment to the Discovery PUD Zoning Agreement, including the Phase 1B final site plan, all earthwork, lake construction, site excavation and mass grading activities to support the golf course and residential areas, future roads, drainageways, lake interconnections, lake littoral zones, upland transition areas and habitat restoration area, was approved October 24, 2023. The amendment included minor changes to the zoning agreement, master site plan and phasing plan.

 

The Second Amendment to the Discovery PUD Zoning Agreement relocated the 18 golf cottages from the main golf course and lake clubhouse tract to the short course clubhouse tract and revised the phasing plan to consolidate the road and lot development program previously approved within Phases 4A and 5 into a single Phase 2A.

 

The Phase 2A final site plan includes the construction of roads, utilities and drainage improvements and support for all 317 single family lots, adjacent common areas and future development tracts. Phase 2A includes the construction of a traffic signal at the projects main entrance on Bridge Road and construction of a public access road from Bridge Road to the existing equestrian and staging areas that will be dedicated to the Atlantic Ridge Preserve State Park.

 

The Discovery PUD plat was approved on April 30, 2024 and recorded in the Official Records of Martin County on July 15, 2024 in OR Book 21, Pages 1-79.

 

This proposed Third Amendment includes revising the master and phasing plans for the purpose of adjusting the Golf Clubhouse and Kid’s Club Adventure Park Recreation Tracts and adding a lake clubhouse within the lake adjacent to the Clubhouse Tract.

 

Review of this application is not required by the Local Planning Agency.

Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.
