The Martin County Community Redevelopment Agency’s (CRA) Gomez Affordable Housing project includes design and construction of water distribution and wastewater collection systems as well as roadway improvements along SE Lewis Way, SE Douglas Way and SE Queen Drive rights-of-way.  The roadway improvements include design and construction of on-street parking spaces, sidewalks, street lighting, and stormwater drainage facilities. 

 

County staff has acquired donations of the property necessary for the CRA project and requests the Board of County Commissioners accept and approve these donations which include two Sidewalk Easements and a Warranty Deed for additional right-of-way.

 

Real Property has verified ownership and the premises are not encumbered by a mortgage except for that certain Mortgage in favor of Saks-Kavanaugh Foundation, whose address is c/o Betty Saks, Co-Trustee, 1688 Meridian Avenue, Suite 700, Miami Beach, Florida 33139, dated May 18, 2018, and recorded May 30, 2018, in Official Records Book 3053, Page 391, Martin County, Florida, public records, which encumbers the easement properties, for which a Consent of Mortgagee has been granted.

 

Sec. 139.31 and 139.32, General Ordinances, Martin County Code require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by Resolution from the Board of County Commissioners of Martin County.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board adopt a Resolution approving and accepting a Warranty Deed for right-of-way and two Sidewalk Easements as part of the Gomez Affordable Housing project and authorize the Chairman to execute any and all documents necessary to complete the transaction.
