This is a request by Mattamy Palm Beach, LLC for an amendment to Article 11, Planned Mixed-Use Village, Land Development Regulations, Martin County Code. Article 11 is the Land development regulations that provide the development standards and review procedures consistent with the MUV, Mixed-Use Village Land Use. The Planned Mixed-Use Village is solely related to the Newfield (fka Pineland Prairie) project in Palm City.

BACKGROUND/RELATED STRATEGIC GOAL:
The Comprehensive Plan Text amendment creating the Mixed-Use Village Land Use (MUV) was approved on August 21 2018, through the adoption of Ordinance 1080. The MUV land use was applied to the approximate 3,411-acre parcel now known as the Newfield (fka Pineland Prairie) project through the adoption of Ordinance 1081 on the same date. The MUV Land Use outlines development parameters for the Newfield project and are not changing through the proposed land development regulations amendment.
The Development agreement for the Newfield project was approve on December 15, 2020. The agreement between the project founder, now Mattamy Palm Beach and the County ensures that level of services and infrastructure improvements will be made according to development timelines and benchmarks. The current proposal does not affect the development agreement.
The first master site plan in the Newfield project was approved on December 15, 2020 for the Crossroads Neighborhood. Final site plans have been approved according to the development procedures outlined in Division 7 of Article 11 and construction has begun.
Through the development review process, the applicant and County staff have identified areas of the code that can be improved by addressing scrivener’s errors, clarifying definitions and providing flexibility to the form-based code while following the original intent and principles of creating a sustainable and walkable traditional neighborhood. The proposed changes to Article 11 do not affect density, open space requirements or any level of service demands.
This matter was heard before the Local Planning Agency (LPA) on October 17, 2024. The LPA voted unanimously to recommend approval of the proposed changes to Article 11.

LEGAL SUFFICIENCY REVIEW:
This is a legislative matter. Legislative decisions are those in which the local government formulates policy rather than applying specific rules to a particular situation. A local government’s approval or denial of an issue in its legislative capacity is typically subject to a fairly debatable standard of review. Fairly debatable means that the government’s action must be upheld if reasonable minds could differ as to the propriety of the decision reached. Decisions subject to the fairly debatable standard of review need only be rationally related to a legitimate public purpose, such as the health, safety, and welfare of the public, to be valid. Given this broad discretion, only decisions that are arbitrary and capricious or illegal are subject to serious legal challenge.

Move that the Board adopt the ordinance for the proposed changes to Article 11, Planned-Mixed Use Development, Land Development Regulations, Martin County Code.
