EXECUTIVE SUMMARY:

This is a request by Lucido & Associates on behalf of Discovery Hobe Sound Investors, LLC for approval of the Discovery PUD plat consistent with the approved Discovery PUD Phase 2A Final Site plan for 317 single-family lots. The subject site is located north of and adjacent to SW Bridge Road, approximately one mile east of the I-95 Interchange in Hobe Sound. Included is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Discovery PUD Zoning Agreement, including master and phasing plans was approved on September 13, 2022 and adopted on September 18, 2023.

 

The Discovery PUD 1st Amendment and Phase 1B final site plan was approved and adopted on October 24, 2023.

 

The Discovery PUD 2nd Amendment and Phase 2A final site plan was approved March 12, 2024.

 

The Discovery PUD project consists of 317 single family residential lots and the associated infrastructure on approximately 1,530 acres located north of and adjacent to SW Bridge Road, approximately one mile east of the I-95 Interchange in Hobe Sound.

 

As a result of the review of said plat application, minor technical adjustments were required to the approved Phase 2A final site plan to ensure consistency with the plat in accordance with Section 10.5.F.6.e.(2), Land Development Regulations, Martin County Code.

 

The applicant is in the process of receiving releases to easements from Florida Power and Light Company and AT&T. Attached to this agenda item is a summary of the easements that must be released or terminated prior to recordation of the plat.  Final signatures from County staff and recordation of the plat will not take place until all releases are recorded.

 

Pursuant to Article 10 of the Martin County Land Development Regulations, review of this application by the Local Planning Agency was not required. Final action on this application is required by the Board in a public meeting pursuant to Table 10.5.F.9, Land Development Regulations, Martin County Code.

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move the Board approve the Discovery PUD Plat, the Phase 2A Revised Final Site Plan, and the Contract for Construction of Required Improvements and Infrastructure contingent upon the release or termination of all easements contained in the Summary of Easements to be Terminated.
