The Pettway neighborhood is currently served by well water. Martin County has agreed to construct the necessary infrastructure to provide potable water, which will be transferred to SMRU upon completion. Phase 1 portion of the Water Main Extension project, located on SE Kingsway Street in Hobe Sound, is being funded by a grant from the Florida Department of Environmental Protection. County staff coordinated with SMRU to address utility assets within the right of way and to offer a Utility Easement to ensure continued service and maintenance.

In compliance with Section 139.50, General Ordinances, Martin County Code, prior to granting this easement, the Board must consider the following:

1. The easement facilitates provisions of the utility's service on the County-owned parcel and provides added value to the site.
2. The service promotes the general welfare by providing the continued service for SMRU equipment.
3. The existence and location of the easement will not interfere with the use by County of the County right of way.
4. There is no consideration to be paid for the easement.
5. SMRU has agreed to cooperate in moving the easement if the County should require.

A sketch and legal description for the Utility Easement has been provided and approved by the County Surveyor.

RECOMMENDED ACTION:

RECOMMENDATION
Move that the Board (i) grant the Town of Jupiter Island, FL d/b/a South Martin Regional Utility (SMRU), a Utility Easement on County-right of way property, in compliance with Section 139.50, General Ordinances, Martin County Code, and (ii) authorize the Chair to execute all documents necessary to complete this transaction.
