This agenda item seeks Board of County Commissioners’ consideration and approval to enter an Interlocal Agreement with the Martin County School Board. The purpose of the agreement is to formalize public access and use of the recreational facilities at Jensen Beach Elementary School.  The proposed agreement will clarify roles, responsibilities, and maintenance obligations for both parties, ensuring efficient management and shared benefits for the community.

BACKGROUND/RELATED STRATEGIC GOAL:

 

In recognition of the significant impact of obesity, diabetes, and other chronic diseases on both individual health and public health costs, Florida Statutes Section 1013.101 encourages broader public access to recreational and sports facilities. The Legislature acknowledges that public schools, supported by taxpayer investment, are well-equipped with indoor and outdoor facilities that can serve as accessible venues for community physical activity. Accordingly, it is the stated policy of the state to promote shared use of school buildings and grounds. District school boards are directed to adopt policies and enter into agreements with local governments and nonprofit organizations to facilitate community access to school recreational facilities outside of school hours. This initiative aims to expand opportunities for healthy lifestyles by increasing the number of school districts that open their playgrounds and recreational spaces to the public.

ISSUES:

 

This interlocal agreement establishes the respective responsibilities and permitted uses for each recreational component located at Jensen Beach Elementary. The agreement specifies that any project costs exceeding $35,000 shall be classified as capital expenditures and further delineates the fiscal obligations of each party regarding such expenditures.

 

Additionally, the agreement outlines the allocation of fiscal responsibilities for normal wear and tear, and the installation or construction of specific recreational components. This ensures clarity regarding which entity is accountable for each aspect of maintenance, repair, and enhancement of the facilities.
