Provide provisions for a proposed public facility for MCPAL expanding their league in furtherance of its commitment to providing kids with a safe environment in which they can develop new friendships and become productive members of society.

On June 2, 2020, the Board of County Commissioners approved an Option to Lease and Public Purpose Lease Agreement with MCPAL. The Option gave MCPAL approximately two (2) years or until April 30, 2022, to submit all required development information to the County with an expiration date of October 31, 2022. Section II, subsection B, of the Option, allows for the extension of the termination date by written agreement of the Parties.
On May 12, 2022, a First Amendment to Option to Lease was executed, granting a two (2) year extension through 5:00 PM on October 31, 2024.
On February 21, 2024, MCPAL requested to extend the term of the Option to Lease for an additional two (2) years as they are still in gathering information to provide the requirements per the Option.
The Second Amendment to Option to Lease provides MCPAL an additional two (2) year extension to all dates indicated in the Option to Lease, including but not limited to submission of all engineering plans, schedules, detailed estimates, reports and operation plan, being due to the County on or before April 30, 2026, and an extension to the date to either accept or terminate the Option until October 31, 2026.

RECOMMENDATION
Move that the Board accept and approve the Second Amendment to Option to Lease, between Martin County and the Martin County Police Athletic League, Inc., a Florida not for profit corporation (MCPAL) and authorize the Chairman to execute any and all documents necessary to complete this transaction.
