This Agreement will allow the Martin County Public Works Department to participate in a joint construction project performing potable water construction within the Gomez/Pettway community.

BACKGROUND/RELATED STRATEGIC GOAL:
1. Agreement drafted by: Martin County Public Works with comments from the County Attorney's Office and the Town of Jupiter Island. The Agreement has already been approved and executed by the Town;
2. Parties to the Agreement: Martin County Board of County Commissioners and Town of Jupiter Island;
3. Purpose of the Agreement: To allow a construction project to provide potable water improvements to the Gomez/Pettway community;
4. New/Renewal/Modified: New Agreement;
5. Duration: The Agreement will terminate when the water system components constructed under the Agreement are completed and transferred to the Town in accordance with the terms of the Agreement;
6. Benefits to Martin County: Provides potable water service to a community that has documented water quality concerns related to their private wells;
7. Cost to Martin County: The Capital Cost for Martin County Components is $300,000 and a $940,000 appropriation was provided by the state through the Department of Environmental Protection for the potable water project. Approximately $120,000 is required to complete the design, permitting, and CEI phases of the project. There are County staff labor and overhead costs associated with construction and interlocal agreement administrative tasks.
The Department of Health has documented through multiple sampling events over several years that shallow drinking water wells in this community are impacted by nutrients and the residents report poor water quality. This is a Martin County project and South Martin Regional Utilities (SMRU) will receive the finished water project components and will serve the affected residents with municipally treated potable water. This neighborhood is considered low to moderate income and is largely within the Hobe Sound Community Redevelopment Area.
The Town, in participation with the County, has designed and prepared preliminary construction drawings for the potable water project. The County will bid and manage the construction project, and the Town, through their consulting engineering contract, will provide engineering oversight for water utility work. The County will provide personnel to inspect and perform duties for work improvements within County Right-of-Way. The Town will obtain construction certification(s) of the permitted water distribution system. All water infrastructure assets will be turned over to the Town for ownership and operation via Bill of Sale.
State Representative John Snyder worked with the District 3 County Commissioner Harold Jenkins and Town of Jupiter Island Vice Mayor Fields to identify State Appropriation funding in the amount of $940,000 to install this critical infrastructure. Community Redevelopment Area (CRA) Tax Increment Financing (TIF) and County District 3 Municipal Service Tax Unit (MSTU) funds will also be utilized to fund this project.
The Interlocal Agreement specifies the roles and responsibilities of the County and the Town for the execution of the project. The Interlocal Agreement has already been approved and executed by the Town.
