This is a request for the approval of a First Amendment to Lease Agreement between Martin County and The District Board of Trustees of Indian River State College (IRSC) to amend the lease boundary to include an additional 30.72 acres for Sports Facilities, along with approval of a Non-Exclusive Access and Maintenance Easement along the main entrance located on SW Citrus Blvd. in western Martin County.  The lease term remains unchanged with this amendment.

On February 22, 2022, the County and The District Board of Trustees of Indian River State College (IRSC) executed a lease for approximately twenty-five (25) acres along SW Citrus Blvd. for the purpose of creating a charter high school. The initial term of this lease is for fifty-five (55) years with the option to renew the lease four (4) additional terms of ten (10) years each, with a final renewal option of four (4) years for a potential total term, including all renewal options of ninety-nine (99) years. Renewals are not automatic and require a one (1) year prior written notice.

 

IRSC has requested an additional 30.72 acres of adjacent land to build, operate, and maintain sports fields and associated sports facilities and structures. The remaining terms of the Lease will remain the same.

 

The County is also providing a Non-Exclusive Access and Maintenance Easement to IRSC for the entrance drive along SW Citrus Blvd. that leads to the Indiantown High School and the future Martin County Fair.

 

In compliance with Section 139.50 General Ordinances, Martin County Code, prior to granting this easement, the Board must consider the following:

 

1.                     The easement facilitates provisions of the access on the County-owned parcel and provides added value to the site.

2.                     The service promotes the general welfare by providing the needed access for the Indiantown High School.

3.                     The existence and location of the easement will not interfere with the use by County of the County property.

4.                     There is no consideration to be paid by IRSC for the easement, as the access is needed for County benefit of use of the High School.

5.                     IRSC has agreed to cooperate in moving the easement if the County should require.

 

A sketch and legal description for the Access and Maintenance Easement has been provided and approved.

RECOMMENDATION

Move that the Board approve the First Amendment to Lease Agreement between Martin County and The District Board of Trustees of Indian River State College and approve a Non-Exclusive Access and Maintenance Easement and authorize the Chair to execute any documents associated with this transaction.
