This is a request for the adoption of a resolution approving and accepting the acquisition of 94 parcels, located within Poinciana Gardens, with 37 parcels owned by PC Realty Ventures, LLC, a Florida limited liability company (10.089 acres) and 57 parcels owned by Luna Blu, Inc., a Florida profit corporation f/k/a Ken Marlin Stuart, Inc. (21.189 acres).  These environmentally sensitive parcels are being acquired by the County with proceeds from the one-half cent sales surtax.

On October 21, 2025, the Martin County Board of County Commissioners (Board) approved moving forward with the acquisitions of the ELOC’s top 16 ranked priority parcels, with funding to be provided from the 10-year Conservation Lands Sales Tax, which was approved in November 2024

 

These 94 Poinciana Gardens parcels (collectively, the “Parcels”), which total 32 +/- acres, were listed at number 15 on the ELOC priority list.  Staff ordered three (3) separate appraisals, using various parcels throughout Poinciana Gardens with no open road frontage, to achieve a basis for fair market value, with individual lots appraising between $27,000 and $50,000 (average value $38,250).  Staff worked with the owner’s agent, who requested a per parcel price, and staff agreed upon a final sale price of $32,000 per parcel.   

 

Real Property staff have reviewed title work and confirmed ownership of the parcels, with no known encumbrances.  Upon final review and approval by the Legal Department, Real Property will proceed toward a closing on or before April 30, 2026.  A survey was not needed for these parcels, as they are platted and have no open road frontage. 

 

In compliance with Florida Statute 286.23, a Beneficial Interest disclosure, along with an Affidavit of No Conflict, were executed prior to the execution of the contract.

 

Sec. 139.31 and 139.32, General Ordinances, Martin County Code, require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by resolution by the Board of County Commissioners of Martin County.

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, and staff have identified and addressed legal risks and developed strategies for legal defensibility, as applicable.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board;

1.                     approve the two separate Vacant Land Contracts in the amount of $1,184,000 (PC Realty Ventures) and $1,824,000 (Luna Blue); and

2.                     adopt a Resolution approving and accepting the purchase of approximately 32 acres in Poinciana Gardens, from PC Realty Ventures, Inc. and Luna Blue, Inc., for continued conservation purposes; and

3.                     authorize the Chair to execute the Resolution and the 2 Vacant Land Contracts; and

4.                     authorize the County Administrator or designee, to execute all closing documents necessary to complete these acquisitions.
