This is a request by Lucido & Associates on behalf of Martin Commerce Park, LLC for approval of the Martin Commerce Park PUD Plat Infrastructure Final Site Plan, including a Phase 1 and 2 final site plan consistent with the Master Site Plan and Phasing Plan. This proposal includes construction of all infrastructure and preserve area requirements for the entire project site, seven buildings totaling approximately 485,084 square feet, and outdoor storage, on an approximate 121.95-acre portion of the 167.18-acre property. Included with this application is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
Comprehensive Plan Amendment (23-09) was approved on November 12, 2024, with the adoption of Ordinance 1233. The amendment created a freestanding urban services district, authorized extension of water and sewer services to the subject property, and restricted development to 1,100,000 square feet of non-residential development.
Comprehensive Plan Amendment (23-10) was approved on November 12, 2024, with the adoption of Ordinance 1234. The amendment to the Future Land Use Map changed the land use from Agricultural and Agricultural Ranchette to Industrial for the subject site. The subject property was concurrently rezoned to LI, Limited Industrial, by way of resolution 24-11.6, also approved November 12, 2024.
The Martin Commerce Park PUD Zoning Agreement, including Master and Phasing plans, was approved by the Board on December 9, 2025.
This proposal includes the plat infrastructure final site plan so the property may be platted, and the existing Martingale Estates lots removed. Also included is the Phase 1 and 2 final site plan consistent with the approved Martin Commerce Park PUD master and phasing plans. Future final site plans that are consistent with special condition 13 of the PUD Zoning Agreement will be processed administratively.
Review of this project by the LPA is not required due to the approved master site plan, pursuant to Table 10.5.F.9., Land Development Regulations, Martin County Code, which requires only one public meeting.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the resolution approving the Plat Infrastructure Final Site Plan for the Martin Commerce Park PUD project.
3. Move that the Board adopt the resolution approving the Phase 1 and 2 Final Site Plan for the Martin Commerce Park PUD project.
