This is a request by MacKenzie Engineering and Planning Inc., on behalf of Meadow Run Property Owners Association Inc., for approval of a revised final site plan to add a rear entry gate at the cul-de-sac on SW Briarbrook Way for the purpose of accessing SW Leighton Farm Avenue. The property is located east of SW Citrus Boulevard, North of I-95 and west of SW Leighton Farm Avenue at 4350 SW Stoneybrook Way in Palm City. Included with this application is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
The Master Site Plan for the Fox Grove Subdivision was initially approved on June 8, 2004, and included a 91-lot subdivision on approximately 543.8 acres with minimum lot sizes of 5 acres, consistent with the Agricultural Ranchette Future Land Use and AR-5A zoning district. This approval was set forth in Resolution 04-6.16, recorded in Martin County Official Records Book 1926, page 1294.
The Fox Grove Subdivision received Final Site Plan approval on September 14, 2004, and included a Preserve Area Management Plan protecting approximately 3 acres of wetland area and 1.74 acres of upland buffers. Resolution 04-9.43 was recorded in Martin County Official Records Book 1954, page 923.
The Fox Grove plat was subsequently recorded on April 15, 2005, in Martin County Official Records Plat Book 16, page 6.
An Administrative Amendment to the Final Site Plan to include a manned guardhouse was approved on February 16, 2006, as set forth in Martin County Official Records Book 2376, page 2376.
This application seeks to add a secondary access gate from SW Leighton Farm Avenue for residents, contractors, and vendors to be located at the existing cul-de-sac of the private road SW Briarbrook Way.

Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the Resolution approving the Revised Final Site Plan for the Meadow Run at Fox Grove Subdivision project.
