This is a request by Cotleur & Hearing on behalf of Rio South Dixie, LLC for major final site plan approval to develop 145 residential units consisting of multi-family, townhome and live/work units and the associated infrastructure on an approximately 14.34-acre undeveloped parcel located in the Rio Community Redevelopment Area (CRA). The subject site is located on the north side of NE Dixie Highway west of NE Martin Avenue. Included in this application is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
The Preserve at Rio Marine received master site plan approval on September 13, 2022. The proposed final site plan is consistent with the previously approved master plan.
The Final Site Plan for The Preserve at Rio Marine Village consists of 145 residential units and the associated infrastructure on approximately 14.34 acres. There is a variety of residential units proposed, consisting of 96 apartment units in four buildings, 44 Townhome units in six buildings and 5 Live/Work units.
The site plan includes a 3.16-acre upland Preserve Area Management Plan (PAMP) to be recorded with the development order. The site plan also includes amenities for the development including a pool area, dog park and dry retention areas that can act as park space throughout much of the year.
The project is within the Primary Urban Services District and water and wastewater will be provided by Martin County Utilities.
Pursuant to Sec. 10.5.F.9, review of this application by the Local Planning Agency is not required.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the Resolution approving the final site plan and the Preserve Area Management Plan for The Preserve at Rio Marine Village project.
