This is a request by Cotleur & Hearing on behalf of Pulte Home Company, LLC for approval of the Third Amendment to the Highpointe Planned Unit Development (PUD) Zoning Agreement to remove an approximately 19.54-acre Camp Valor, a/k/a Operation 300 site from the Highpointe PUD and add six single family lots to the development bringing the total to 290 lots on an approximately 301.46-acre property resulting in a gross density of 1 unit per acre. The property is located at 10205 Pratt Whitney Road in Stuart. Included with this application is a request for a Deferral of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
The Highpointe Planned Unit Development (PUD) including Master Site Plan was approved April 27, 2021. The approval included the Operation 300 Parcel (Camp Valor), existing Christ Fellowship Church, and a single-family residential subdivision consisting of a maximum of 284 lots and related infrastructure.
The Phase 1 Final Site Plan including 94 single family lots received approval on September 28, 2021.
The Phase 1 Plat and First Amendment were approved on May 3, 2022.
The Second Amendment to the Highpointe PUD Zoning Agreement, including Revised Master Site Plan, Revised Phasing Plan, Amended Preserve Area Management Plan (PAMP), and Phase 2 Final Site Plan were approved on November 7, 2023.
This Third Amendment to the Highpointe PUD Zoning Agreement proposes to remove the Operation 300 parcel from the PUD and revise the Master Site Plan to show the new boundaries between the Institutional and Residential areas resulting from an additional approximately 5.7 acres of land acquired by Pulte from Christ Fellowship Church. Six lots have been added to an open space tract in the Phase 2 development, bringing the proposed number of units to 290 and a resulting density of 1 unit per acre.
This proposed amendment requires no modifications to the Preserve Area Management Plan (PAMP).
This item was heard by the Local Planning Agency (LPA) on October 17, 2024. The LPA recommended approval with a vote of 3-0.

Because this request involves the application of a policy specific application and site, it is a quasi- judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.

1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board approve the Third Amendment to the Highpointe PUD Zoning Agreement including Revised Master Site Plan.
