PREPARED BY:                      Name: Lisa A Wichser, P.E., CFM

                     Title:                     Chief Project Engineer

REQUESTED BY: FDOT District 4 Maintenance Systems Administrator

PRESET:

PROCEDURES: None

BACKGROUND/RELATED STRATEGIC GOAL:

                      Agreement drafted by:                     Florida Department of Transportation (FDOT) legal staff

                     Parties to the Agreement:                     FDOT and Martin County

                     Purpose of the Agreement:                     To establish responsibility for maintaining streetlights along roads on the State Highway System and to establish a rate of compensation

                     New/Renewal/Modified:                     The Agreement supersedes those Agreements executed in 2003

                     Duration:                     Seven years

                     Benefits to Martin County:                     Maintaining the streetlights on the State Highway System allows the County to achieve an economy of scale for an in-house street light crew that maintains County streetlights, resulting in more cost-effective and efficient operations while providing a more timely and responsive level of service compared to FDOT or its contractors.

                     Cost to Martin County:                     The County receives compensation for maintaining the streetlights.

The County authorized the Chair to execute four State Highway Lighting, Maintenance, and Compensation Agreements with the Florida Department of Transportation (FDOT) in June 2003.  The FDOT has recently updated the State Highway Lighting, Maintenance, and Compensation Agreement (Agreement) to:

                     incorporate standard, legally formal language, including definitions;

                     include explicit E-Verify, public records, and Israel/Sudan/Iran boycott certification clauses;

                     include terms for the acceptance of new facilities;

                     include Exhibit A to identify location of the lights and annual escalation rate (3%);

                     revise the deadlines for invoicing;

                     include provisions for enforcement and cancellation; and

                     establish a duration (7 years).

At the request of Martin County staff, the FDOT agreed to consolidate the four Agreements into one new Agreement.  The Board is asked to authorize the County Administrator or designee to sign the Agreement and future amendments thereto.
