BACKGROUND/RELATED STRATEGIC GOAL:

 

The subject property is developed with a duplex, both sides of which are owned by Ruth Campbell. On February 10, 2005, the owner recorded a Unity of Title to document the use of both sides of the duplex as a single-family home and to qualify the entire property for homestead protections. In 2019, the owner rented out one side of the duplex and retained the other side as homestead. The Property Appraiser’s office was informed; however, the Unity of Title was never released.

 

The property is located within the City of Stuart; however, a form that is typically used for land in unincorporated Martin County was used to file the Unity of Title with the Clerk of Court. Therefore, the Unity of Title may only be released by the Board of County Commissioners.

 

The owner is now attempting to sell one-half of the duplex and desires to close on the sale sometime in May. One-half of the duplex cannot be sold until the Unity of Title is released by the Board of County Commissioners.
