This request is for the adoption of a Resolution accepting future land acquisitions of individually owned environmentally sensitive lands through tax deed sale within Poinciana Gardens. The funding for these parcels will utilize revenue from the one-half cent (0.5%) Local Governmental Infrastructure Surtax for properties recommended by the Environmental Lands Oversight Committee (ELOC) and approved by the Board of County Commissioners (Board).

BACKGROUND/RELATED STRATEGIC GOAL:
The undeveloped western portion of Poinciana Gardens contains roughly 200+ acres of wetland and environmentally sensitive lands. The Poinciana Gardens parcels were listed at number 15 on the ELOC’s priority list of 16 approved projects by the Board on October 21, 2025, as part of the November 2024 10-year tax referendum for environmentally sensitive lands.
Martin County Currently owns approximately 56-acres within the Poinciana Gardens western unopened section.
With the Board’s approval, staff would like to participate in online Tax Deed Sales through the Martin County Clerk of the Circuit Court. In order to efficiently expedite the process of acquiring these environmentally sensitive properties, staff is seeking adoption of a resolution approving and accepting all future deeds, acceptable to the County Attorney’s office, at a price consistent with prior acquisitions within the designated section of Poinciana Gardens.
Sections 139.31 and 139.32, General Ordinances, Martin County Code, require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by Resolution from the Board of County Commissioners of Martin County.
Funding from the project will come from the Conservation Lands Sales Tax.

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, and staff have identified and addressed legal risks and developed strategies for legal defensibility, as applicable.
RECOMMENDED ACTION:
RECOMMENDATION
Move that the Board:
1. adopt a Resolution approving and accepting all future tax deeds, acceptable to the County Attorney’s Office, conveying individually owned environmentally sensitive lands through Tax Deed Sales, within Poinciana Gardens for a price consistent with prior acquisition within the designated unopened western portion of Poinciana Gardens, plus closing costs; and
2. authorize staff to participate in any online Martin County Clerk of Court Tax Deed Sale to acquire environmentally sensitive lands within the designated area of Poinciana Gardens for a price consistent with prior acquisitions; and
3. authorize the Chair to execute any documents necessary to complete this transaction.
