BACKGROUND/RELATED STRATEGIC GOAL:
The property is approximately 1219-acres and is located west and east of Kanner Highway approximately 2.4 miles southwest of Interstate 95 at 3100 SW Delivery Street in Stuart.
Three Lakes Golf Club, LLC received a change in zoning classification from A-1, Small Farms and A-2, Agricultural District to AG-20A General Agricultural District on August 16, 2022 (B115-006) and
received final site plan and Preserve Area Management Plan (PAMP) approval for two golf courses and related amenities on September 27, 2022. (B115-005)
The project received revised final site plan approval on June 6, 2023, approving a golf clubhouse and 14 accessory golf cottages and associated infrastructure including a utility waiver for 5,000 gallons per day (GPD) on-site wastewater treatment. (B117-007)
Adoption of the Future Land Use Map (FLUM) amendment for Three Lakes Golf Club changing the Future Land Use from Agricultural to Rural Lifestyle occurred on February 20, 2024. (CPA 11-11, Ordinance 1219)
The Three Lakes Golf Club Planned Unit Development (PUD) zoning agreement including master and phasing plans was approved on February 20, 2024. Included was previously approved development as the PUD’s phase 1 final site plan. (B115-003)
The Phase 2 Final Site Plan was approved on June 18, 2024 and included connection to water and wastewater, the North Course golf course, performance center, east maintenance building, golf training center, and 8 golf cottages on an approximate 282-acre portion of the project site.
This first amendment to the Three Lakes Golf Club PUD agreement with revised master and phasing plans and Phase 3 final site plan proposes revisions to the existing Phase 1 and 2, as well as additional features consistent with the master plan, including revisions to cottages and amenities, replacing the proposed tunnel under Kanner Highway with a rural bridge, removal of the gated entrance at SW Apogee Way and associated turn lane improvements, and moving the employee housing facilities to Phase 4. Phase 3 construction is located throughout the project and includes an approximately 142-acre portion of the 1,216.75-acre site.
Review of this application is not required by the Local Planning Agency (LPA).

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.
RECOMMENDED ACTION:
RECOMMENDATION
1. Move the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move the Board approve the First Amendment to the Three Lakes Golf Club PUD Zoning Agreement including the Revised Master and Phasing Plans
3. Move that the Board adopt a resolution to approve the Phase 3 Final Site Plan for the Three Lakes Golf Club PUD project.
