This is a request by HJA Design Studio on behalf of Coastal Waste & Recycling of Martin County, LLC, for approval of the Third Amendment to the Coastal Waste & Recycling PUD Zoning Agreement including a revised master/final site plan to construct an approximately 7,800 square foot vehicular maintenance building, a 4,000 square foot office building, and associated infrastructure. The 22.7-acre site is located at 12967 SE Suzanne Drive, approximately 0.25 miles southeast of the intersection of SE Suzanne Drive and SE Bridge Road, in Hobe Sound. Included is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:

 

This is a request by HJA Design Studio on behalf of Coastal Waste & Recycling of Martin County, LLC, for approval of the Third Amendment to the Coastal Waste & Recycling PUD Zoning Agreement including a revised master/final site plan to construct an approximately 7,800 square foot vehicular maintenance building, a 4,000 square foot office building, and associated infrastructure. The area of the proposed improvements is an existing unpaved, stabilized storage area located in the southwestern portion of the approximately 22.7-acre site located at 12967 SE Suzanne Drive in Hobe Sound.

 

Water and wastewater will continue to be provided by South Martin Regional Utilities. Access to the site is provided from SE Suzanne Drive via a platted public access easement recorded in Martin County Plat Book 11, Page 74.

 

The proposed Third Amendment includes a revised timetable for development. As a PUD public benefit, the amendment also includes a stipulation that within 60 days of approval, the owner shall pay the Martin County Public Works Department the sum of $25,000.00, which shall be used for the maintenance of SE Suzanne Drive.

 

The project was formerly known as the Nu-Way Recycling Corporation. The PUD Zoning Agreement and master site plan were approved on December 21, 2004. A final site plan was approved on March 1, 2005. The First PUD Amendment was approved on July 12, 2022, and the Second PUD Amendment was approved on March 22, 2023.

 

Pursuant to Article 10, Table 10.5.F.9, Martin County Land Development Regulations, review of this application is not required by the Local Planning Agency (LPA).

There are no unresolved issues related to this application.

 

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move the Board approve the Third Amendment to the Coastal Waste & Recycling PUD Zoning Agreement including the Revised Master/Final Site Plan.
