Board approval is requested of an Interlocal Agreement between the County and Village of Indiantown concerning the parties agreement to continue the fire rescue and parks and recreation services currently provided by the County within the Village as well as the Village’s agreement to pay for such services. Approval is also requested for a Roadway Transfer Agreement which provides for the transfer of certain local roads and related stormwater facilities to the Village as well as a Resolution authorizing such roadway transfer agreement.

BACKGROUND/RELATED STRATEGIC GOAL:

 

Village and County staff have prepared an Interlocal Agreement which sets forth the rights and responsibilities concerning the Village’s implementation and levy of certain taxes needed to pay the County to provide services identical to those previously provided by the County’s Fire-Rescue and Parks and Recreation MSTU’s and to provide a methodology to transfer rights-of-way and stormwater facilities within the Village from the County to the Village. The Interlocal Agreement includes as Exhibit “A” a Roadway Transfer Agreement between the County and the Village which transfers certain road rights of way within the Village boundary including improvements thereon (roadbed, curbs, sidewalks, bike paths, traffic control, signals and signs, warning flashers, drainage structures and culverts, streetlights, landscape, railroad crossings and other enhancements). Section 2 of the Transfer Agreement specifies the collector and arterial roads within Village boundaries that the County will retain.

 

I.                     Interlocal Agreement

3.                     Purpose of Agreement: Provide mechanism for provision and payment of Fire Rescue and Parks and Recreation Services as well as roadway and stormwater transfer methodology

5.                     Duration: October 1, 2018 until terminated by either party as provided in Agreement

6.                     Benefits to Martin County: Provides a mechanism to be paid for the provision of Fire Rescue and Parks and Recreation Services to the Village

7.                     Cost to Martin County: This Agreement should be revenue neutral since the Village will be paying for the services provided

 

II.                     Roadway Transfer Agreement

1.                     Agreement drafted by: Lisa Wichser, County Engineer

2.                     Parties to Agreement: Martin County and the Village of Indiantown

3.                     Purpose of Agreement: To provide for the transfer of certain roads and stormwater infrastructure to the Village

4.                     New Agreement

5.                     Duration: Termination upon mutual agreement of parties

6.                     Benefits to Martin County: Transfer of roads and stormwater infrastructure to Village

7.                     Cost to Martin County: None

RECOMMENDATION

1.                     Move that the Board approve the Interlocal Agreement with the Village of Indiantown.

2.                     Move that the Board approve the Roadway Transfer Agreement with the Village of Indiantown.

3.                     Move that the Board approve the Resolution authorizing such roadway Transfer agreement.
