This is a request by Cotleur & Hearing, on behalf of Pulte Home Company LLC, for Revised Final Site Plan approval for Phase 2 of the Highpointe Planned Unit Development (PUD) consistent with the approved Revised Master Site Plan, which added six lots to Phase 2 increasing the total from 190 to 196 lots. The site is located along SW Pratt Whitney Road on the northwest corner of Pratt Whitney and Bulldog Way, within the Secondary Urban Service District, in Stuart. Included in this application is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
The Highpointe PUD, including Master Site Plan, was approved on April 27, 2021, and recorded in Martin County Official Records (OR) Book 3240, Page 2850. The Master Site Plan included 284 single family home lots on approximately 321 acres that included a 28-acre place of worship.
The Highpointe PUD, Phase 1 Final Site Plan to develop 94 single-family lots on approximately 175 acres of the property was approved with resolution 21-9.48 on September 28, 2021, and recorded in OR Book 3271, Page 200. The Phase 1 Plat was recorded on August 4, 2022, in Plat Book 19, Page 37.
The Highpointe PUD, Phase 2 Final Site Plan to develop 190 lots on approximately 145 acres of the property was approved on November 7, 2023, and recorded in OR Book 3419, Page 349. The Phase 2 Plat was recorded on October 18th, 2024, in Plat Book 22, Page 1.
The Third Amendment to the Highpointe PUD amended the Master Site Plan by adding six single family lots and removing the Camp Valor site, approximately 20 acres, from the Highpointe PUD. The Camp Valor site was donated to “Operation 300” through the Highpointe PUD agreement. The Third amendment was approved on November 12th, 2024, and recorded in OR Book 3482, Page 2587.
This Revised Phase 2 Final Site Plan for the Highpointe PUD is required for consistency with the approved revised master site plan and provides the site information for the six added lots so they may be platted and conveyed.
Review of this application by the Local Planning Agency is not required.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the Resolution approving the revised Phase 2 Final Site Plan for Highpointe PUD.
