Staff regularly performs record searches almost exclusively at the request of real estate title insurance companies.  The requirements to continually produce the searches in a timely manner are challenging for staff.  This agreement will allow ODS to provide record searches for open/expired building permits and active code enforcement cases on behalf of the County.  A Resolution is included which establishes a fee schedule of $75.00 for the record search service; a $50.00 rebate will be returned to the County for each search ODS performs which will help offset the costs to run the Department.

 

The Building Department (BD) funds its Plan Review and Inspections operations from customer user fees for the services provided and does not utilize any ad valorem tax money.  The use of the revenue generated is limited to the enforcement of the Florida Building Code (FBC) and any excess funds must be utilized and accounted for in accordance with statutory requirements.

 

The BD has examined its current work volume and the anticipated work volume for FY26 as well as the expected valuations.  The fees associated with the properties having construction costs more than $1,000,000 require a revision to the BD’s schedule to stay in compliance with the FBC. Therefore, BD is recommending a reduction in the fee schedule based scaled percentages in the attached Resolution.

 

ISSUES:

 

A survey of 16 other government entities in Florida utilizing the ODS services shows record search fees ranging from $50.00 to $150.00 with the average being $95.65.

 

The use of BD’s fees are regulated by Florida Statutes Chapter 553.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board approve the Services Agreement with PropLogix, LLC d\b\a Orange Data Systems, adopt the Resolution establishing a fee schedule and authorize the Chair to execute all documents necessary to complete the transaction.
