This is a request for the approval of a Non-Exclusive Flow-Through Drainage Easement (“Easement”) on the parcel being re-conveyed to the County as part of a transaction with Medalist Building Group, LLC, for surplus property located adjacent to Danforth Creek and SW Newberry Court in Palm City.  This easement is being provided by the County to satisfy a title requirement for closing.

BACKGROUND/RELATED STRATEGIC GOAL:

 

On July 8, 2025, the Board of County Commissioners accepted the proposal for RFP2025-3672 for the sale and development of a surplus-designated County owned property located at 3500 SW Palm City School Avenue (“Property”). As a part of this proposal, the County will sell the Property to the winning bidder, Medalist Building Group, LLC, a Florida limited liability company (“Medalist”), and Medalist will re-convey to the County by quitclaim deed a portion of the Property located west of SW Newberry Court and adjacent to Newberry Creek to be used for creek maintenance and other purposes.   

 

As part of the title requirements for closing on the Property, the County must provide the attached Easement to Medalist to cover the current catch basins that accept water from the portion of the Property located east of SW Newberry Court.  Once approved and executed, the Easement will be held in escrow pending successful closing on the Property, which is anticipated to occur on January 30, 2026.

 

Pursuant to Section 125.35, Florida Statutes, the Board of County Commissioners is authorized to sell and convey any interest in real property whenever the board determines that it is in the best interest of the County to do so, to the highest and best bidder after a public hearing and adoption of a resolution declaring the property as surplus.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board approve the Non-Exclusive Flow Through Drainage Easement to Medalist Building Group, LLC, a Florida limited liability company, and authorize the County Administrator or designee to execute all documents related to this request.
