This is a request by Cotleur & Hearing on behalf of Rio South Dixie, LLC, for approval of the Rio Marine Village Phase II (West) Major Final Site Plan. The west phase contains one retail building, two restaurant buildings, and one mixed use building, dock slips and outside boat storage, along with the associated infrastructure. Phase II is generally located south of NE Dixie Highway, north of the St. Lucie River, and west of NE Martin Avenue. Included is a request for a certificate of public facilities reservation.

BACKGROUND/RELATED STRATEGIC GOAL:
The Rio Marine Village Project received Master Site Plan approval on February 1st, 2022. Rio Marine Village Phase II (West) Major Final Site Plan shall be in compliance with a revised Master Site Plan that is being reviewed with Phase I (East). The East and West Final Site plans form the entirety of the Rio Marine Village redevelopment project.
The future land use of the property is CRA Center and CRA Commercial Waterfront. The subject property is zoned Rio Redevelopment Zoning District with approximately 1.09 acres of Core Subdistrict and approximately 4.93 acres of Waterfront Subdistrict. The proposed density is under the permitted 15 dwelling units per acre when utilizing density blending.
Phase II (west) has one access point proposed from NE Dixie Highway with two additional access connections from NE Martin Avenue via an extension of NE St. Lucie Terrace and the existing NE Stuart Street connection.
The project is within the Primary Urban Service Boundary and water and wastewater will be provided by Martin County Utilities.
Pursuant to Sec. 10.5.F.9, review of this application by the Local Planning Agency is not required.

Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt the Resolution approving the final site plan for Rio Marine Village Phase II (West).
