This is a request for the adoption of a Resolution approving and accepting a Right-of-Way Easement (“ROW Easement”) from the School Board of Martin County (“SBMC”), a political subdivision of the State of Florida, to allow for a sidewalk project along SW Bulldog Way at South Fork High School for a Capital Projects ROW Florida Department of Transportation (FDOT) Transportation Alternatives Program (TAP) project.

Capital Projects determined that a sidewalk was needed as part of a TAP project along SW Bulldog Way for the students at South Fork High School. The property is owned by the SBMC, who approved the easement at their October 21, 2025, meeting and have provided the 15’ wide Right-of-Way Easement for the sidewalk project.  This project was programmed by FDOT in the FY28 FDOT ROW TAP Project and approved at the October 21, 2025, School Board meeting.

 

The Real Property Division has confirmed ownership of the easement premises, and there are no mortgages encumbering the easement area.

 

Sec. 139.31 and 139.32, General Ordinances, Martin County Code require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by Resolution from the Board of County Commissioners of Martin County.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board adopt the Resolution approving and accepting the Right-of-Way Easement conveyed by the School Board of Martin County, a political subdivision of the State of Florida, as part of the FDOT ROW TAP Project and authorize the Chair to execute all documents associated with this transaction.
