This is a request by Lucido and Associates on behalf of South Florida Gateway Industrial, LLC, for plat approval for South Florida Gateway PUD Plat No. 2. The plat is to be consistent with the South Florida Gateway PUD Revised Infrastructure Final Site Plan. The approximately 32.26 acres site is a portion of the approximately 216.37-acre Master Plan and is located on the west side of SW Kanner Highway approximately 0.6 miles south of SW 96th Street in Stuart. Included is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:
The South Florida Gateway PUD and Master Site Plan were approved by the Board of County Commissioners (Board) on February 1, 2022. The Final Site Plan for Plat Infrastructure was approved by the Board on May 17, 2022. On June 18, 2024, 32.26 acres were added to the South Florida Gateway PUD through Resolution 24-6.16 and the South Florida Gateway Second Amendment to the PUD Zoning Agreement, which revised the Master Site Plan to include the new Lot IND-3.
The Revised Infrastructure Plan under separate application includes roads and utility extensions along the privately owned and maintained SW Gateway Place so Lot IND-3 may be platted and conveyed.
This application is to plat the additional Lot IND-3 and infrastructure changes to be consistent with the Revised Infrastructure Final Site Plan.
Pursuant to Article 10 of the Martin County Land Development Regulations, review of this application by the Local Planning Agency was not required. Final action on this application is required by the Board in a public meeting pursuant to Table 10.5.F.9, Land Development Regulations, Martin County Code.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board approve the South Florida Gateway PUD Plat No. 2. including the Contract for Construction of Required Improvements and Infrastructure.
