BACKGROUND/RELATED STRATEGIC GOAL:
The Public Works Department has a history of requests for roadway improvements on SW Earl Avenue from SW Ulmus Place to SW Sunset Trail lying within the plat of Henderson's Addition in Palm City. The roadway was dedicated as a 50-foot-wide Public Right-of-Way (ROW) easement within the plat of Henderson's Addition in 1925. The roadway was not accepted into the County Road Inventory for operation and maintenance at the time of construction, even though all other roadways on the plat were accepted. SW Earl Avenue is the only way to access the publicly maintained SW Ulmus Place. It appears that many property owners along the publicly maintained SW Thelma St also utilize SW Earl Avenue as a means of ingress/egress to their community.
Roadways that were not accepted by the County prior to 1972 are typically conveyed to the adjacent frontage properties for operation and maintenance, including roadway and drainage maintenance for the safety and welfare of the public. Since the road is not in the County Road Inventory, the County currently has no legal obligation to maintain it and the adjacent property owners are required to maintain it.
The current roadway condition exhibits evidence of little to no maintenance performance for an extended period of time, leading to a deteriorated condition with structural failure. The County's pavement condition rating is "poor," requiring a full-depth reclamation from the asphalt surface to the bottom of the structural base layer. The roadway has a single frontage property owner (property shown in Exhibit ‘A’) in which the County would typically assess within a Roadway Municipal Service Benefit Unit (MSBU) for roadway improvements to meet County Standards and allow for acceptance into the County Road Inventory for ownership and perpetual maintenance.
ISSUES:
SW Earl Avenue does not meet County Standards and requires roadway rehabilitation for safe conveyance of vehicular traffic. Currently, the roadway is classified as publicly dedicated but privately maintained bearing responsibility of maintenance on the adjacent frontage property owners. SW Earl Avenue currently has only one adjacent frontage property owner and two driveway connections along the entire 608-foot-long roadway section in which the County would typically assess within a Roadway MSBU for improvements to County Standards and acceptance into County Road Inventory. The cost for improvements is approximately $83,000 (cost estimate of improvements shown in Exhibit ’B’) which would customarily be split between two property owners.
Because the roadway is an open public ROW within the Urban Service District, serving approximately 45 properties within the Henderson Addition platted neighborhood for ingress and egress, and in poor condition beyond the responsible control of a single property owner, staff is recommending the County perform improvements in the interest of the health, safety, and welfare of the County. If authorized, the following road characteristics will be added into the County’s Road Inventory upon completion of construction and acceptance by the County:

Sec. 155.4, Acceptance of Maintenance, General Ordinances, Martin County Code, only public roads, streets, or thoroughfares that have been constructed and paved according to the roadway design standards, Article 4, Division 19, Land Development Regulations, Martin County Code, shall be accepted for maintenance by the County.
