This is a request by USA Auto Wash, LLC, for approval of the South Kanner Car Wash plat. The plat is to be consistent with the South Kanner Car Wash Revised Final Site Plan which contains two commercial lots. The approximately 3.74-acre subject site is located on the west side of South Kanner Highway, approximately 0.2 miles northeast of the intersection of South Kanner Highway and Southwest Salerno Road, in Stuart. Included is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:
The South Kanner Car Wash Plat creates two commercial lots with associated access, drainage, and utility easements on an approximately 3.74-acre site. Proposed Lot 1 is approximately 2.42 acres while proposed Lot 2 is approximately 1.32 acres. The South Kanner Car Wash final site plan was approved on January 16, 2024. The final site plan included a 3,975 square foot single tunnel car wash with associated infrastructure on Lot 1. Access to the site is provided from South Kanner Highway.
As a result of the review of the plat application, minor technical adjustments were required to the previously approved final site plan for the South Kanner Car Wash project to achieve consistency with the plat in accordance with Section 10.5.F.6(e), Land Development Regulations, Martin County Code. The minor technical adjustments to the final site plan were approved on February 17, 2025.
Contract and security for the completion of improvements and infrastructure are not required.
Pursuant to Article 10 of the Martin County Land Development Regulations, review of this application by the Local Planning Agency was not required. Final action on this application is required by the Board in a public meeting pursuant to Table 10.5.F.9, Land Development Regulations, Martin County Code.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi -judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.
2. Move that the Board approve the South Kanner Car Wash Plat.
