The Pettway neighborhood is currently using well water. The Water Main Extension project, located in Hobe Sound, is being funded by a grant from the Florida Department of Environmental Protection. Martin County has agreed to construct the necessary infrastructure to provide potable water, which will be transferred to SMRU upon completion. County staff coordinated with SMRU to address utility assets along County-owned property and within the County right-of-way and to offer Utility Easements to ensure continued service and maintenance.
In compliance with Section 139.50 General Ordinances, Martin County Code, prior to granting this easement, the Board must consider the following:
1. The easements facilitate provision of the utility’s service on the County-owned parcels and provide added value to the site.
2. The service promotes the general welfare by providing the continued service for SMRU equipment.
3. The existence and location of the easement will not interfere with the use by County of the County property and right-of-way.
4. There is no consideration to be paid for the easement.
5. SMRU has agreed to cooperate in moving the easement if the County should require.
Sketches and legal descriptions for the Utility Easements have not been finalized and will be reviewed and approved prior to recordation.
ISSUES:
Sketches and legal descriptions have not been finalized. The Utility Easements will not be recorded until they are provided by the County Surveying Division.

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, and staff have identified and addressed legal risks and have developed strategies for legal defensibility, if applicable.
RECOMMENDED ACTION:
RECOMMENDATION
Move that the Board (i) grant the Town of Jupiter Island, Florida d/b/a South Martin Regional Utility, four Utility Easements, in compliance with Section 139.50, General Ordinances, Martin Couty Code, and (ii) authorize the Chair to execute all documents necessary to complete this transaction.
