BACKGROUND/RELATED STRATEGIC GOAL:

 

This item was initially planned for discussion at the August 6, 2024 meeting, but due to a tie vote and Commissioner Hetherington’s absence, the Board continued it to August 27.  With Commissioner Jenkins also being absent on August 27, there was a concern about another tie vote, leading the County Administrator to decide that the item would be rescheduled for September 10, 2024.

                     

 

The Board of Zoning Adjustment is organized pursuant to Section 9.5 of the Land Development Regulations. The Board shall consist of seven members appointed by the Board of County Commissioners as follows: one member shall be appointed from each county commission district.

 

Prior to the appointment, the member shall have been a registered voter in the district for at least one year. The term of office of the member shall coincide with the term of office of the County Commissioner representing the district from which the member was appointed.  The member's term of office shall terminate earlier if the member ceases to be a registered voter in the district from which the member was appointed.  In addition, the member may be removed from office at the pleasure of the Board of County Commissioners.

 

Two at-large members shall be appointed on a countywide basis. Prior to their appointment, the members shall have been a registered voter in Martin County for at least one year.  After initial appointment all at-large appointments shall be for a term of four years terminating on November 30.  The member's term of office shall terminate earlier if the member ceases to be a registered voter in Martin County. In addition, the member may be removed from office at the pleasure of the Board of County Commissioners.

 

The Board of Zoning Adjustment meets in the Commission Chambers at 7:00 PM on the fourth Thursday of each month.  Their agendas are published to the County’s web site in a timely manner.

 

On June 13, 2024, the Administration Staff received a notification of resignation from Rodney Sturm who has served on the Board of Zoning Adjustment since December 2013.  Per previous Board direction, Administration Staff prepared a Certificate of Appreciation and a letter thanking him for serving which will be signed by the Chairman.

 

On June 24, 2024, an Information Release soliciting applicants was emailed via Constant Contact to the Outreach Martin and Local Media which includes local Chambers of Commerce, local businesses, and citizens.  The Information Release was also posted to the County’s web page under News.

 

Administration Staff confirmed through the Supervisor of Elections Office that all the applicants are Martin County registered voter as required.

 

The Administration Staff will advise all the applicants of the appointment which will include Sunshine Law information and the Form-1 Statement of Financial Interests information to the appointed individual.  If Mr. Sturm is not re-appointed, the framed Certificate of Appreciation and Chair letter will be sent to him.

 

ISSUES:

 

The Board is asked to appoint one individual to the Board of Zoning Adjustment for a term to begin immediately and end November 30, 2025.  A voting sheet is attached.

Administration staff determined that Mr. Rodney Sturm resigned from the Board on June 13, 2024 via an email when he was having trouble logging into his county-issued email address and filing Form 1 online with the Florida Commission on Ethics.  Staff waited six business days to begin soliciting in case he changed his mind.  On June 27, 2024, Mr. Sturm inquired about continuing to serve on the Board of Zoning Adjustment, so staff sent him an application to complete and return.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board appoint one individual to the Board of Zoning Adjustment for a term to begin immediately and end November 30, 2025 and authorize the Chairman to sign the Resolution of Appointment.
