BACKGROUND/RELATED STRATEGIC GOAL:
This is a request by Kimley-Horn and Associates, Inc., on behalf of Storage Rentals of America, for PUD final site plan approval to construct a 3-story, 32,500 square foot (97,500 square foot total gross floor area) self-storage facility and associated infrastructure on approximately 2.51 acres, currently a vacant parcel within the Eastridge Estates PUD. The property is located at the southwest corner of SE Dixie Highway and SE Osprey Street, in Hobe Sound. Included is a request for a Certificate of Public Facilities Reservation.
The PUD Zoning Agreement for this property, dated June 27, 1978, identifies the subject property as a “commercial area” (Lot 21, Block I) of the existing approximately 71.74-acre Eastridge Estates PUD, which includes single family, duplex, multifamily sites, a park and the subject commercial area.
The applicant is proposing alternative compliance from the primary façade transparency/fenestration provision of Division 20, Commercial, Multifamily, and Industrial Design, Article 4, Land Development Regulations (LDR), Martin County Code.
A parking rate adjustment request has been reviewed by staff. Consistent with residential storage facilities in Martin County, the parking rate has been adjusted to conform with the needs of the facility.
The future land use designation for the subject property is Commercial General with a PUD zoning district. Access to the property is proposed from one location on SE Sandy Lane.
The property is abutting the South Martin Regional Utility Water Plant to the west, which is also part of the Eastridge Estates PUD, and the Ridgeway Mobile Home subdivision to the north.
Due to the project being consistent with the approved PUD master site plan, a review of the application by the Local Planning Agency was not required.

LEGAL SUFFICIENCY REVIEW:
Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.
