This is a request by Cotleur and Hearing, on behalf of Christ Fellowship Church Inc, for approval of the Second Amendment to the Highpointe PUD Zoning Agreement, including Revised Master Site Plan, Revised Phasing Plan and Amended Preserve Area Management Plan, and a Phase 2 Final Site Plan to construct 190 single-family homes, an amenities center, and associated infrastructure. The 145.31-acre subject site is located within the 321-acre PUD, along SW Pratt Whitney Road, in Stuart. Included is a request for a Certificate of Public Facilities Reservation for Phase 2.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Highpointe PUD was originally approved as a 2-phase master plan in 2021 to construct 284 single-family homes and associated infrastructure, incorporate the existing church into the master site plan, and establish a 20-acre parcel to be utilized by the Operation 300 non-profit organization. The Phase 1 Final Site Plan was also approved in 2021, to construct 94 single-family homes and execute the donation of 19.54 acres for the Operation 300 parcel. The First Amendment to the Highpointe PUD with a Revised Master Site Plan, Revised Phasing, and a Revised Phase 1 Final Site Plan was approved during the Phase 1 Plat public hearing. The 321-acre PUD is located along the east side of SW Pratt Whitney Road, approximately 1.1 miles north of Bridge Road, in Stuart.

The current proposal for the Second Amendment to the Highpointe PUD Zoning Agreement modifies portions of the PUD Agreement, revises the Master Site Plan, Phasing Plan and Special Conditions, and amends the Preserve Area Management Plan (PAMP). The Phase 2 Final Site Plan authorizes development of 190 single-family homes, an amenities center, improvements to Bulldog Way, and other associated infrastructure. The Phase 2 site is located on 145.31 acres within the 321-acre PUD.

 

A PAMP has been provided by the applicant to make consistency changes to the preserve area and native landscape area data. There are no proposed changes to the existing preserve boundary with this amendment.

 

Pursuant to Section 10.5.F.9, Article 10, Land Development Regulations, Martin County Code, a review of this application by the Local Planning Agency is not required.

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy to a specific application and site it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move that the Board receive and file the agenda item and all attachments, including the Staff Report, as Exhibit 1.

2.                     Move that the Board approve the Second Amendment to the Highpointe PUD including a Revised Master Site Plan, a Revised Phasing Plan, and an Amended Preserve Area Management Plan.

3.                     Move that the Board adopt the resolution approving the Phase 2 Final Site Plan for the Highpointe PUD.

RECOMMENDATION

The applicant has paid a$13,800 PUD Zoning and Master Site Plan application fee and associated $290 completeness fee, a $9,127.00 PUD Final Site Plan application fee and associated $290 completeness fee, and previously paid a $25,000 Public Works PUD Discretionary Fee.
