This is a request by Lucido & Associates, on behalf of Hobe Sound Business Park, LLC, for a proposed amendment to the Martin County zoning atlas to change the zoning district classification for an approximately 108.1-acre property from the current A-1, Small Farms District, and M-1, Industrial District, to the GI, General Industrial District. The GI zoning district is consistent with the site’s future land use designation of Industrial. Included is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The subject site consists of approximately 108.1 acres of pasture and undeveloped land located on the east side of SE Powerline Avenue, approximately 100 feet south of the intersection of SE Powerline Avenue and SE Bridge Road, in Hobe Sound. The eastern 104.4 acres of the subject site are currently zoned M-1, Industrial District, while the western 3.7 acres of the subject site adjacent to SE Powerline Avenue are zoned A-1, Small Farms District. The future land use (FLU) designation of the subject site is Industrial. The A-1 zoning district is a Category “C” district and is not consistent with the Industrial FLU assigned to the property; therefore, this request to rezone is considered mandatory. Although consistent with the Industrial FLU, the M-1 area is included in the scope of this rezoning as it is under common ownership and is also a Category “C” district.

 

There are three (3) standard Category “A” zoning districts available to implement the Industrial future land use policies of the Comprehensive Growth Management Plan (CGMP) which are LI (Limited Industrial District), GI (General Industrial District), and HI (Heavy Industrial District). In addition to the standard zoning districts, Planned Unit Development (PUD) zoning is also available as an option. A PUD offers more design flexibility to applicants for proposed projects. In exchange, the PUD requires additional benefits to the County and more controls by the County. The applicant is proposing to rezone to the GI, General Industrial District.

 

This item is scheduled to be heard by the Local Planning Agency on September 3, 2026. The recommendation will be provided to the Board of County Commissioners.

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy to a specific application and site, it is a quasi -judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move that the Board adopt a Resolution amending the Martin County Zoning Atlas to change the zoning district designation on the subject site from A-1, Small Farms District, and M-1, Industrial District, to the GI, General Industrial District.
