This is a request by Lucido & Associates on behalf of DR Horton, Inc., for approval of the 2nd Amendment to the Preserve at Park Trace PUD Zoning Agreement including a Revised Master and Final Site Plan to construct recreation facilities and a stub out resulting in a reduction of 2 lots for a total of 112 lots. The site is approximately 97 acres located at 2320 SE Cove Road in Stuart on the south side of Cove Road at the intersection of Willoughby Boulevard. Included with this application is a request for a Certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Preserve at Park Trace PUD Zoning Agreement was approved on September 28, 2021 and included the development of 114 single-family lots on approximately 34-acres of the 97-acre site. The remaining 63-acres consists of wetland and upland preserve and the required buffers protected by a Preserve Area Management Plan (PAMP).

 

The First Amendment to The Preserve at Park Trace PUD consisted of minor technical changes to the Master and Final Site Plan to achieve consistency with the plat and was approved September 12, 2023.

 

This proposed Second Amendment to The Preserve at Park Trace (PUD) Zoning Agreement consists of revising the Master and Final Site Plan, to remove lots 50 and 51 to facilitate the construction of a stub out and to provide private recreational facilities. Approval of this amendment will reduce the single-family lots from 114 to 112 residential units on 97 acres resulting in a net density of 1.2 units per acre.

 

This application meets the threshold criteria for a major development, with a previously approved master plan.

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION

1.                     Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move that the Board approve the 2nd Amendment to The Preserve at Park Trace PUD Zoning Agreement including the Revised Master and Final Site Plan.
