REQUESTED BY: Creech Land Use & Zoning, P.A., Audra Creech

PRESET:

PROCEDURES: None

BACKGROUND/RELATED STRATEGIC GOAL:

The subject site is adjacent to the All Saints Episcopal Church at 2303 NE Seaview Drive, Jensen Beach. The subject site is located west of NE Dixie Highway and east of the FEC Railroad, approximately 300 feet south of the intersection of NE Dixie Highway and NE Indian River Drive, in Jensen Beach.

The site is currently zoned A-2, Agricultural District, with a Future Land Use (FLU) designation of General Institutional. The A-2, Agricultural District, is a Category “C” district that is not consistent with the General Institutional FLU assigned to the property. Additionally, a covenant to the PS zoning district was established on the subject site in 1995, as recorded in Official Records Book 1140, Page 2054, Martin County, Florida.

The PS-2, Public Service District, is the only standard Category “A” zoning district available which both implements the General Institutional land use policies of the Comprehensive Growth Management Plan (CGMP) and permits the current use of the property as a cemetery. In addition to the standard zoning district, the PUD (Planned Unit Development) District is also available. The PUD District offers more design flexibility to applicants for proposed projects. In exchange the district requires additional benefits to the County and more controls by the County. The applicant is proposing to rezone the property to the PS-2, Public Service District.

This item has been scheduled for consideration by the Local Planning Agency on October 3, 2024, and the recommendation will be provided to the Board of County Commissioners.

In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDED ACTION:

RECOMMENDATION
