This is a request by HFA-AE LTD, on behalf of Brew Horizons LLC, for a proposed amendment to the county zoning atlas.  The proposed amendment is to change the existing zoning district classification for approximately 1.93 acres from M-1 (Industrial) district to LI (Limited Industrial) district.  The approximately 1.93-acre property consists of one parcel located at 3101 SE Federal Highway, approximately 560 feet north of SE Indian Street and just south of SE Carnivale Court, in Stuart. Included with this application is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The existing Industrial M-1 district is a Category “C” zoning district, which is consistent with the Industrial future land use designation pursuant to Section 3.402, Land Development Regulations (LDR), Martin County Code. However, the property is also subject to covenant agreements (Covenant #210 to LI and Covenant #182 to LI); therefore, this rezoning request is considered mandatory pursuant to Section 3.401.B, LDR, Martin County Code.

 

There are three (3) standard Category “A” zoning districts available for implementing the Industrial land use policies of the Comprehensive Growth Management Plan (CGMP): LI (Limited Industrial District), GI (General Industrial District) and HI (Heavy Industrial District). The applicant is proposing a rezoning to the LI (Limited Industrial District).

 

This item has been scheduled for consideration by the Local Planning Agency on July 16, 2026,

and the recommendation will be provided to the Board of County Commissioners.

LEGAL SUFFICIENCY REVIEW:

 

Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move that the Board adopt a Resolution amending the Martin County Zoning Atlas to change the zoning district designation on the subject site from M-1, Industrial District, to LI, Limited Industrial District.

The applicant has paid the $1,000.00 application fee and the $290.00 completeness fee.
