This is a request by Gunster on behalf of 456 South Ocean, LLC for a proposed amendment to the county zoning atlas to change the existing zoning district on 38 parcels with an approximate area of 1,913.59-acres from A-1, Small Farms District and A-2, Agricultural District to AR-5A, Agricultural Ranchette District. The subject site is located at the northeast intersection of SW 96th Street and SW Citrus Boulevard, west of the Saint Lucie River extending north to Interstate 95 and the Florida Turnpike in Palm City. Included with this application is a request for a Certificate of Public Facilities Exemption.

BACKGROUND/RELATED STRATEGIC GOAL:
The property’s zoning districts are A-1, Small Farms District consistent with an Agricultural Ranchette Future Land Use (FLU) and A-2, Agricultural District which is consistent with an Agricultural FLU. Both A-1 and A-2 are Category “C” zoning districts defined in Article 3, Division 7 of the Martin County Land Development Regulations (LDR’s). The properties FLU is Agricultural Ranchette. The A-2 zoning district is inconsistent with the underlying Future Land Use Map (FLUM) of the County’s Comprehensive Growth Management Plan (CGMP) therefore this request to rezone is considered mandatory per Section 3.402 of the Martin County Land Development Regulations (2016).
This application proposes a Category “A” zoning district that is consistent with the Future Land Use Map of the Comprehensive Growth Management Plan (CGMP). Category “A” zoning districts were developed specifically to implement the CGMP. Therefore, this proposal is consistent with the CGMP goals, policies and procedures.
This item has been scheduled for consideration by the Local Planning Agency on August 7, 2025 and the recommendation will be provided to the Board of County Commissioners.

Because this request involves the application of a policy specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision that is based on a correct application of the law and competent substantial evidence in the record.

RECOMMENDATION
1. Move that the Board receive and file the agenda item and all its attachments including the staff report as Exhibit 1.
2. Move that the Board adopt a resolution approving the request to rezone from A-1, Small Farms District and A-2, Agricultural District to AR-5A, Agricultural Ranchette District.
