The Utilities & Solid Waste Department have completed design and permitting of a proposed water main extension project for the Coral Lakes subdivision in Stuart. The rights-of-way in Coral Lakes are privately owned by the Coral Lakes Homeowners Association, Inc. and do not currently allow for the extension of public utilities. This Utility Easement will allow for the construction of such assets upon adoption of the resolution thereby creating the proposed Coral Lakes Municipal Service Benefit Unit, which will be presented to the Board by the Utilities & Solid Waste Department later this year.

 

The Real Property Division has confirmed ownership of the easement premises in Coral Lakes Homeowners Association, Inc., a Florida not-for-profit corporation, and there are no mortgages or encumbrances on the easement premises.

 

Sections 139.31 and 139.32, General Ordinances, Martin County Code, requires that any conveyance of an interest in the land to Martin County for any public purposes shall be accepted and approved by Resolution from the Board of County Commissioners of Martin County.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board (i) adopt the Resolution accepting and approving the Utility Easement conveyed by Coral Lakes Homeowners Association, Inc., a Florida not-for-profit corporation, and (ii) authorize the Chair to execute all documents associated with this transaction.
